Resumo

Esse artigo apresenta uma visão panorâmica dos estudos sobre o tema ambiental e, particularmente, sobre instrumentos econômicos (IE). Discute, também, as novas perspectivas quanto à utilização dos instrumentos econômicos sob a ótica das externalidades positivas emanadas do meio ambiente, potencializando os efeitos dos IE na gestão pública. São trazidos para análise temas como: necessidade econômica e de preservação do meio ambiente e as causas da degradação do ecossistema; crescimento econômico, desenvolvimento sustentável e a responsabilidade do Estado nesse processo, principais problemas ambientais e as políticas públicas ambientais; bem como os instrumentos econômicos ambientais. No âmbito deste último tema, inserem-se os estudos sobre ICMS ambiental e sua aplicação nos municípios que compõem o Pólo de Confecções do Agreste Pernambucano, durante o exercício de 2011. Conclui-se com este estudo que o ICMS Socioambiental dos municípios analisados não é utilizado prioritariamente na proteção do meio ambiente, uma vez que alguns requisitos para recebimento dos recursos ambientais, definidos na Lei Estadual, não são considerados quando da distribuição dos valores, bem como que não há como impor a utilização total dos recursos repassados, pois a Constituição Brasileira não permite vincular recurso de impostos a despesas específicas. No final do artigo aponta-se a necessidade de ações dos órgãos de controle ou maiores incentivos como premiação ao cumprimento dos requisitos da legislação. Sugere-se, também, que o controle dos recursos do ICMS Socioambiental seja realizado através de uma conta específica, bem como que seja elaborado um demonstrativo periódico da arrecadação e aplicação dos recursos aqui tratados, para análise dos órgãos responsáveis, e aprimoramento da legislação.
